Beneficiary name

Capture the full registered name of the beneficiary as it appears in the contract of sale or on their proforma invoice, that is if the company name is SETTLERS (1820) (PTY) LTD, do not use shortened or popular abbreviations such as SETTLERS LTD or SETTLERS (PTY) LTD. The name is used on all documents, including those giving title to the goods.

Beneficiary address

Capture the beneficiary&146;s full address. The information is required by the advising bank. Use more than one address line per field (separated by a comma) as space for address details is limited to 35 characters per field.

Insert the beneficiary's phone number. The information assists the advising bank to notify the beneficiary promptly and eliminates unnecessary delays.

Advise through bank

State the bank and branch,nominated by beneficiary, through which the documentary credit is to be advised. Standard Bank prefers to nominate the advising bank who can verify the authenticity of the transaction. This will eliminate delays and reduce costs.

Merchandise description

Consult a shipping or forwarding agent to determine the exact description of the goods. The Department of Customs and Excise will use the description (H.S. code / tariff heading) given in determining the duties applicable to the commodity. Using the wrong description could result higher duties being paid.

Shipment from port/country

Specify the point of departure as agreed with the beneficiary. Grant the beneficiary leeway by selecting &147;any port/airport&148; in the country of origin, for example, shipment from &147;any German port.&148; This allows the use of another point of departure if the nominated one is closed for any reason.

Shipment to port/country

Be precise as to the place of discharge of the goods, for example, "Durban" or "Johannesburg via Durban". A broad statement such as &147;to any Southern African port&148;, could result in the goods being discharged anywhere in Africa south of the equator. Take cognisance of Exchange Control Regulations if the goods are not being shipped to South Africa, i.e. merchanting trade.

Partial shipments permitted

Tick only if the goods are to be sent in more than one shipment. The deciding factor is whether the goods are required as one complete consignment or whether they can be shipped in part lots.

Complete only if partial shipments are allowed; the shipment dates for each shipment are known; and the supplier must adhere to the dates. The dates may not exceed the stated latest date of shipment.

Trans shipments permitted

Tick only if the goods are to be transported using more than one mode of transport or &147;vehicle&148;. Always tick where multi-modal transport is used. In the case of break bulk cargo, transhipment should be prohibited owing to the inherent risks and resultant increase costs of insurance cover.

Ship not later than

Specify final date of shipment for all the goods. The latest shipment date plus the presentation period must equal the expiry date of the documentary credit. Allow for the availability of transport, inspection requirements and inland transport.

Documents to be presented within

Specify the period in which the supplier must present documents for negotiation. The general rule is a maximum of 21 days. The period is usually based on the turn-a-round time of the vessel, for example, if a ship takes 12 days to arrive at its destination, the applicant may restrict the presentation period to 7 days. This ensures possession of shipping documents to clear the goods before incurring demurrage.

Expiry date

Latest date for presentation of documents by the beneficiary to negotiating bank. The expiry date is the sum of the presentation period and the latest date of shipment. It is the date on which the liability of the applicant / issuing bank / confirming bank under the documentary credit falls away.

Expiry place

The place of expiry is usually stated as country to which the documentary credit is directed.

Currency

Capture currency as agreed with supplier. Avoid errors such as inserting a US Dollar currency in stead of an Australian dollar currency in the documentary credit.

Amount

Capture the amount as agreed in the contract of sale or proforma invoice. Exercise care with regard to partial shipments, tolerance levels, unit prices and provision for the cost of freight, insurance premiums and other incidental charges.

Balance

This is the balance available under the documentary credit including amendments, payments and drawings. This will reflect on the 'newlook' only.

Percentage tolerance - plus

Specify,as a percentage, the tolerance level by which the documentary credit amount, unit price and quantity of the goods may be exceeded; usually between 5% and 10%. Insert "0" if no tolerance level is permitted.

Percentage tolerance - minus

Specify,as a percentage, the tolerance level by which the documentary credit amount, unit price and quantity of the goods may be reduced; usually between 5% and 10%. Insert "0" if no tolerance level is permitted.

Amount may be exceeded for

Insert the services, such as freight, packaging, inland transport, insurance premiums, commissions and other incidental charges, which are not included in the documentary credit amount, but may be claimed by the beneficiary.

Documentary credit transferable

Tick the box if the beneficiary is to transfer all or part of his rights under the documentary credit to one or more parties (second beneficiaries). It is usually required where the beneficiary is a middleman who does not produce the merchandise, but acts as an agent for the buyer or seller, or both.

Specify the mixed payment terms. For example, the purchase of capital equipment can entail a deposit (30 %), a portion (60 %) payable on presentation of confirming documents and the balance (10%) on commissioning of the machine. Ensure that the payment terms can be calculated/determined by the bank

Confirmation

Indicate whether or not the advising bank is to add its guarantee of payment to this letter of credit. Usually requested by the supplier.

Charges

This charge is levied by the advising bank that verifies the authenticity of the documentary credit and advices it to the beneficiary. The charge also applies when advising of any subsequent amendments / cancellations

Reimbursing commission

The charge is levied by the bank that debits the issuing bank's account in its books with the foreign currency amount and that pays the negotiating bank.

Confirmation charges

This charge is levied by the bank that adds it's confirmation (guarantee of payment). Confirmation fees are based on a confirming bank&146;s assessment of the financial, economic and political risks associated with the issuing bank and country.

Negotiation commission

This charge is levied by the bank processing the drawings under the documentary credit. The negotiating / paying bank checks that all documents comply with the terms and conditions of the documentary credit, claims reimbursement and pays the beneficiary.

Acceptance/deferred payment commission

This charge is levied by the negotiating bank on "usance" (term) payments under a documentary credit. The bank accepts and pays the beneficiary immediately by discounting the drawing or undertakes to make payment at a future date.

Discount charges

This is an interest charged by the negotiating bank when it discounts a drawing under a documentary credit.

All other charges outside South Africa

These are incidental charges, such as telephone calls to the beneficiary and courier fees, incurred by the foreign banks.

In cases where a bill of entry number is not available and an ICN cannot be compiled, the invoice number which represents the payment offshore must be supplied. A prefix INV must be supplied followed by the invoice number related to the payment effected, i.e. INV000000. The invoice number supplied by the importer to the Authorised Dealer must also be supplied to Customs to be reflected in Box "13A. INVOICE NO. AND DATE" on the SAD 500 Customs Declaration Form. In the case of bulk payments against multiple invoices, only one invoice number must be consistently supplied to Customs and the Authorised Dealer.
